Most people have a legal advisor, but it is unlikely that they are well versed in Spanish Law. Because of this we would recommend that you choose a Spanish based lawyer who is familiar with the area, and all the other requirements when purchasing a property in Spain. We would be able, without prejudice, to introduce/recommend you to a number of English speaking lawyers who can advise you in relation to all matters concerning the purchase of your property in Spain. This will include checking out the property itself to confirm that it falls within the legal parameters, also that the appropriate build licenses are in place, and that there are no outstanding issues relating to the property.
Your legal advisor will arrange for you to have an N.I.E number (which is a requirement for all non-residents who purchase a property in Spain) they will also deal with all matters relating to your contract, and make the necessary arrangements for a meeting with the Notary (Registrar) in order to register you as the legal owner of the deeds (Escritoire). With regard to resale properties they will carry out the usual searches to confirm that there are no outstanding debts on the property.
Besides this your legal advisor will make you aware of any tax issues that may be relevant to you, and even draw up a Spanish Will if you so wish (this is recommended if and when you purchase a property in Spain). Many people actually give over Power of Attorney to their Solicitor, which means that with your instruction, they can act on your behalf. This will mean that they can complete the purchase of your property, and all other legal requirements whilst you return to the U.K. (this is a perfectly normal way of buying a property in Spain)
